I got a question to those who suggested a police report (i did too at the top, but for a different reason). I suggested it so that the guy doesnt claim that there wasnt even an accident at all. It seems that most of you suggest it as a proof of fault. Im a little confused because whenever I have seen an accident report it shows no indication of fault on it.
Maybe im missing something. All it has is the two drivers informations, the damage, date time location, witness names, names of people that were injured/died, and on the back your supposed to draw how it happened (you do this yourself, not an officer, and separately from the other driver so they may differ), and then your supposed to send it in to police hq. Im in chicago, and theres thoudands of accident per week, i think you have 7 days to file a police report after the accident. The whole process seems very disorganized.
So im not clear on how the report assigns blame, and i doubt when its sent in to police hq after you draw a pic on the back that they investigate thousands of reports weekly. I have noticed that the person who seems to be not at fault is usually listed as driver 1, is that how it is assigned, #1 no fault, #2 at fault. can someone clear this up?
another question, i have never personally filed an insurance claim so here it is. when you want to file a claim and the other driver is at fault, such as in evldave's case, do you contact your agent so he can start the process or go directly to the other drivers insurance company and file the claim there? I ask this because my dad, and a buddy (two separate occasions) were told by Allstate agent to do directly to the other company and file there, is this how it is?
