View Full Version : "Vehicle Swap Out" help needed!!!!!

It's looking like I might be a candidate for trading in my H3 for a new one. After not having my H3 for the last 16days b/c the Hummer Dealer in PA, Scott Hummer, was fixing my rear differential, I FINALLY go to pick up my truck today.

Looks great...they detailed if for me which was really nice b/c it was extremely dirty from the Paragon trip. So, I drive off the lot and onto the highway. Hit about 60mph and left off the gas....this god awful noise sounds! Sounded like a toned down 18-Wheelers Jake Brake going off. So, took the next exit, turned right around went back to the dealer. Rich, "the service manager guy? and I took it for a cruise on the interstate so he could see for himself what I was talking about.

Well...HE (not the tech) seems to think that NOW my drive shaft is bent!?! All I know, is that my H3 wasn?t making that sound when I dropped it off at Scott Hummer. What I find extra funny about this though...is my local dealer had a "car runner" drive to PA, pick up my truck and drive it back. We are talking a 10hour drive...650miles! The guy that drove it NEVER said a thing to anyone about the problem!!!

So, now my contact at GM, Richard, is looking into a possible vehicle swap. At first, for the front and rear diff. troubles, they were giving me an extended warranty, paying me back, etc. and if I have any other serious problems could result in a swap. Well...here I am. Going on 30 days w/in the first year w/o my truck so LEMON LAW in SC is a possibility.

So my question is: What do you know about the swap out process?

Any help would be appreciated!!!

Hey Hi. I've read a lot of your posts. That really sucks about the dealer issues. can't offer any help, but just wanted to say good luck. Are you going to get anything different if they let you swap?

From what I have heard, lemon laws sound better on paper than in reality. You may want to check your state, but it is my understanding that you only get a trade-in value for your old vehicle, so most people end up spending thousands under the lemon law. I would try to negotiate a straight swap before invoking the lemon law.

From what I have read about lemon laws, you are falling for what GM wants you to do, not what the law says. If you win a lemon law complaint, GM must give you all of your money, downpayment, taxes, payments, etc back and then a fair value for the miles used will be negotiated.

Before swapping, I suggest you find one of the lemon law lawyers on the web and consult with them. All will review your case for free because also GM must fully pay for all lawyer fees under the lemon law and so if you have a good case, they will take it.

HIHUMMER, I had a vehicle swap with my dealer and it was a breeze. I had a bad rear diff, TCCM module 4 times and rear locker replacment twice. :mad: It seems that GM Hummer WILL NOT LET YOU LEMON LAW a vehicle theses days. They do not want the negative press. (cant blame them) IF your dealer is reputable and wants to make sure it goes smooth a new H3 should be in your hands in less than a week. (in my case it was 4 days).

I actuallY used the lemon law a few years ago with a saturn Vue. First the fuel pump shut off and stranded me. Then there was aglitch with a security system that shut off the new fuel pump that stranded me once again. Then it just quit driving down the highway. They said they were going to put a new wiring harness on it. I told them I was more than understanding when it came to few minor repairs, but I used this vehicle on long distance drives every week(Ref pro hockey so lots and lots of miles during the season). I told them if this happened during the season, that I would probably be fired for missing a game. They then offered me a free 100000mile warranty for free. I then told them if they did not give me a new truck that they would receive a certified letter from my attorney first thing in the morning. They said they would have to call me first thing the next morning. Funny thing is when they called, me it was only to tell me that they had a brand new truck waiting on the lot for me. The only thing I had to pay was the mileage on my old truck. Which they even turned out to only charge me the mileage up to my first problem. I would assume that being GM your process would be pretty similar. I might try using the female traveling alone thing. What happens if this breaks in the middle of the night in the middle of nowhere. It's worth a shot.

I'm in Columbia dealing with Columbiana Hummer. The dealership has been great through all this. I still highly recommend them (and the H3)...and if you do decide to buy, I have a great contact at Columbiana. Let me know if you'd be interested. :D

I love my sunroof. If you get one w/ sunroof you will use it and love it! Perfect when the sun goes down.

And of course crawl speeds on the offroad pkg is awesome. (I can now drive slower than anyone I know):D :D

My sunroof got most of it's use when someone was hanging out the top of it, screaming at the top of her lungs to some Bon Jovi Song!!!:eek: :D

If you have a great relationship with the dealer then swap out the truck and make sure it is a late production date. Better yet tell them you want a 07. Be reasonable about the miles you put on your rig and as long as your willing to be flexable on the use you got out of your truck before the problems, do it. Lemon law is there to protect but you probally don't want a hummer after that plus GM will stop all contact with you and it's up to your lawer. Not a very nice way to go if you like the Hummer. Listen to Fstop and i recomend a swap.

Yeah, I may be looking to buy a 06 as the 07's come out. If you have a contact in Columbia that would be great. I am trying to save a little money back for it first.

Good luck on getting a swap HI. That sounds like it would be appropriate after all of the BS and reliability issues.

You know what you want: Adventure, Auto, UCP, Rockrails, Sunroof, 315's before you leave the dealership. Pick a color (Yellow, right?), kick some a$$, and drive out of there with a new H3.

I had a Jeep Grand Cherokee replaced.I had to get the same options, but they did let me change the color.
