Lots of things are legal in one situation but not in another. You can yell 'fire' and pull the alarm lever in a crowded theater ... if there's actually a fire. But you'll get arrested if there isn't one (or if you set it).

Freedom of speech doesn't give people the right to harass others or commit crimes. It allows them to criticize the government without going to jail. Burning a flag at a funeral or in front of a veteran's house disturbs the peace and directly harasses someone. Filing a permit to hold a public rally and burn a flag peacefully as government protest is something different.

If flag-burning became illegal, could someone burn full-color posters of the flag instead? How about flag colored clothing, underwear, bandanas, shop rags, paint designs, stickers or cars painted with a flag. Where would the ban stop?

Personally, I DO NOT agree with flag-burning ... I only support the right to peaceful protest .
